How your Hawaii claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Hawaii claim gets built on two things: the Hawaii lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Hilo Lemon Law

Hilo Lemon Law Basics

The law that applies in Hilo is Hawaii's lemon law, Haw. Rev. Stat. §481I-1 to §481I-4, and it covers new motor vehicles purchased or leased in Hawaii for personal, family, or household purposes. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Hawaii Lemon Law Attorneys page.

Step by Step

How a Hilo Lemon Law Claim Works

This is what happens after you call us from Hilo.

1

Document Your Repairs

Keep every repair order from your Hilo dealership, even the short ones. Under Hawaii's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Hawaii statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Haw. Rev. Stat. §481I-1 to §481I-4

Is Your Hilo Car a Lemon? Hawaii's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Hawaii law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Hawaii the test is 3 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Hawaii, a claim must be filed within 1 year after the lemon law rights period ends. The rights period is the express warranty term, 2 years, or 24,000 miles from delivery, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Hawaii County

Court and Venue in Hilo

Hilo is in Hawaii County. Hawaii County's general civil trial court is the Circuit Court of the Third Circuit. Hawaii also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Hawaii lemon law is Haw. Rev. Stat. §481I-1 to §481I-4. The consumer may go directly to court or use voluntary arbitration.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Fees come through the state certified arbitration program: the prevailing party, consumer or manufacturer, may be allowed reasonable attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Hawaii Lemon Law: The Rules That Decide a Hilo Claim

We covered the repair test and the arbitration rule in the Court and Venue section above. Below are other Hawaii rules that can matter to a Hilo claim.

Notable provisions of Hawaii Lemon Law

Hawaii counts business days for out-of-service calculations. The law also covers motor vehicles used for short-term rentals, and it provides for potential treble damages for manufacturer bad faith.

Your Rights Under Hawaii Law

What The Manufacturer Owes You

Under the statute, the remedy open to Hawaii drivers is a replacement vehicle or a full refund, minus a reasonable allowance for use. If your Hilo car qualifies, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Hawaii law and on the paperwork Hilo drivers usually send us.

PROCESS & TIMELINE
Most of the Hawaii cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Hawaii, a claim must be filed within 1 year after the lemon law rights period ends. The rights period is the express warranty term, 2 years, or 24,000 miles from delivery, whichever comes first.
Usually not. Most lemon law cases we handle for Hilo drivers settle with the manufacturer before a lawsuit is filed. In Hawaii, arbitration is not required. You may go directly to court or use voluntary arbitration.
REMEDIES
Under Haw. Rev. Stat. §481I-1 to §481I-4, the remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Hawaii, fees come through the state certified arbitration program: the prevailing party, consumer or manufacturer, may be allowed reasonable attorney fees. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Hawaii, fees come through the state certified arbitration program: the prevailing party, consumer or manufacturer, may be allowed reasonable attorney fees. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
