Gloucester Lemon Law

Gloucester Lemon Law Basics

A Gloucester car is judged against New Jersey's statute, N.J. Stat. §56:12-29 to §56:12-49, and that law covers new motor vehicles purchased or leased in New Jersey for personal, family, or household use, and certain used vehicles. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our New Jersey Lemon Law Attorneys page.

Step by Step

How a Gloucester Lemon Law Claim Works

This is what happens after you call us from Gloucester.

1

Document Your Repairs

Keep every repair order from your Gloucester dealership, even the short ones. NJ lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the New Jersey statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that NJ law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

N.J. Stat. §56:12-29 to §56:12-49

Is Your Gloucester Car a Lemon? New Jersey's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under New Jersey law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In New Jersey the test is 3 repair attempts for the same defect (or 1 for serious safety defects), or 20 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In New Jersey the deadline is 2 years or 24,000 miles from original delivery (whichever is earlier). We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Camden County

Court and Venue in Gloucester

Gloucester Township is in Camden County. Camden County's general civil trial court is the Superior Court of New Jersey, Law Division, Civil Part, Camden County, part of the Camden Vicinage. Smaller claims stay in the Superior Court but go to its Special Civil Part. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The New Jersey lemon law is N.J. Stat. §56:12-29 to §56:12-49. Notice to the manufacturer goes by certified mail, return receipt requested (N.J.S.A. §56:12-33(b)), and the manufacturer then gets one repair opportunity within 10 calendar days of receiving it. The consumer may go directly to court or use voluntary arbitration.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 20 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle, full refund, or cash settlement. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Notable provisions of New Jersey Lemon Law

New Jersey is one of the strongest lemon law states — only 20 days out of service, no mandatory arbitration, and it also has a separate Used Car Lemon Law covering used vehicles bought from dealers. One repair attempt is sufficient for serious safety defects.

Your Rights Under NJ Law

What The Manufacturer Owes You

New Jersey's statute lists replacement vehicle, full refund, or cash settlement. In practice, a qualifying Gloucester case under NJ law usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused.

Have Questions?

Frequently Asked Questions

The answers below are based on New Jersey law and on the paperwork Gloucester drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Gloucester dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under N.J. Stat. §56:12-29 to §56:12-49, your Gloucester car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect (or 1 for serious safety defects), or 20 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in New Jersey for personal, family, or household use, and certain used vehicles.
N.J. Stat. §56:12-29 to §56:12-49 covers new motor vehicles purchased or leased in New Jersey for personal, family, or household use, and certain used vehicles. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
REMEDIES
In New Jersey, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle New Jersey cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in N.J. Stat. §56:12-29 to §56:12-49 requires you to appear anywhere to open a claim. On arbitration, the New Jersey rule is: consumer may proceed directly to court or use voluntary arbitration.
Nothing upfront, and no attorney's fee unless we recover for you. In New Jersey, the manufacturer pays the consumer's attorney's fees when the consumer wins. In most successful New Jersey claims, the manufacturer pays our fee. Repair orders are free from the dealer. We pay the filing costs while the case is open. “My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”

“My Dodge Challenger's AC would blow hot air on the driver side but cold on passenger. Dealer recharged it twice, replaced a blend door actuator once. Problem came back every time. I was sweating through my shirt in August. Called Easy Lemon and Aaron Waldo said a climate control issue that makes driving uncomfortable counts. His team fought Dodge and got me a cash settlement. Got it fixed at a local shop and the AC has been cold ever since.”

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”
