How your Virginia claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. Fredericksburg Lemon Law

Fredericksburg Lemon Law Basics

In Fredericksburg, as anywhere else in Virginia, a lemon law claim is brought under Va. Code §59.1-207.9 to §59.1-207.16. The statute covers new motor vehicles purchased or leased in Virginia for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Virginia Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Fredericksburg Lemon Law Claim Works

This is what happens after you call us from Fredericksburg.

1

Document Your Repairs

Keep every repair order from your Fredericksburg dealership, even the short ones. VA lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Virginia statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that VA law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Fredericksburg Car a Lemon? Virginia's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Virginia law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Virginia the test is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Virginia the deadline is 18 months from the date of original delivery. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Independent city

Court and Venue in Fredericksburg

Fredericksburg is an independent city; the Census lists it as Fredericksburg city, outside any county. Its general civil trial court is the Fredericksburg Circuit Court, part of the 15th Judicial Circuit of Virginia. Virginia also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Virginia lemon law is Va. Code §59.1-207.9 to §59.1-207.16. The consumer must use a state-certified arbitration program before litigation.

The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails is entitled to reasonable attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Virginia Motor Vehicle Warranty Enforcement Act (Virginia Lemon Law): The Rules That Decide a Fredericksburg Claim

If you have read Court and Venue above, you already have the repair test, the arbitration rule and the deadline. Virginia law adds a few rules on top of those, and they follow.

Notable provisions of Virginia Motor Vehicle Warranty Enforcement Act (Virginia Lemon Law)

Virginia is consumer-friendly with only 3 repair attempts required. One attempt is sufficient for defects creating serious risk of death or injury. Covers 18 months from delivery. Written notice to manufacturer required.

Your Rights Under VA Law

What The Manufacturer Owes You

What the manufacturer owes under Virginia's statute is replacement vehicle or full refund (minus reasonable use offset). Most qualifying cases from Fredericksburg under VA law end in one of the three results below.

$

Refund

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.

Replacement Vehicle

You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.

$

Cash Settlement

You keep driving the car and the manufacturer pays you for the lost value. This is a negotiated result, since the statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Virginia law and on the paperwork Fredericksburg drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Fredericksburg dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Fredericksburg drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Virginia rule is: must use state-certified arbitration program before litigation. We prepare that filing for you.
ELIGIBILITY
It may. Under Va. Code §59.1-207.9 to §59.1-207.16, your Fredericksburg car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Virginia for personal, family, or household use.
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. Virginia is consumer-friendly with only 3 repair attempts required.
REMEDIES
Va. Code §59.1-207.9 to §59.1-207.16 provides for replacement vehicle or full refund (minus reasonable use offset). Which one you get depends on your repair history and on what the manufacturer offers.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Virginia cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Va. Code §59.1-207.9 to §59.1-207.16 requires you to appear anywhere to open a claim. On arbitration, the Virginia rule is: must use state-certified arbitration program before litigation.

What Our Clients Are Saying

Easy Lemon has handled 1,500+ lemon law matters‡.

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
