How your Kentucky claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Kentucky claim gets built on two things: the Kentucky lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Elizabethtown Lemon Law Basics

Claims from Elizabethtown fall under Ky. Rev. Stat. §367.840 to §367.846, which covers new motor vehicles purchased or leased in Kentucky for personal use. If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Kentucky Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How an Elizabethtown Lemon Law Claim Works

This is what happens after you call us from Elizabethtown.

1

Document Your Repairs

Keep every repair order from your Elizabethtown dealership, even the short ones. Under Kentucky's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Kentucky statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written report of the defect to the manufacturer that Kentucky law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ky. Rev. Stat. §367.840 to §367.846

Is Your Elizabethtown Car a Lemon? Kentucky's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Kentucky law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Kentucky the test is 4 repair attempts for the same defect or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Kentucky, a claim must be filed within 2 years after the date of original delivery of the vehicle to the buyer. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Hardin County

Court and Venue in Elizabethtown

Elizabethtown is in Hardin County. Hardin County's general civil trial court is the Hardin County Circuit Court, part of the 9th Judicial Circuit. Kentucky also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Kentucky lemon law is Ky. Rev. Stat. §367.840 to §367.846. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The court may award reasonable attorney fees to a plaintiff who prevails.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Kentucky Lemon Law - Motor Vehicle Warranty Act: The Rules That Decide an Elizabethtown Claim

Court and Venue above gives you the repair test and the arbitration rule. Kentucky law adds a few rules on top of those, and they follow.

Notable provisions of Kentucky Lemon Law - Motor Vehicle Warranty Act

Kentucky's coverage window is 12 months or 12,000 miles. The buyer must report the nonconformity to the manufacturer in writing. Motor homes, motorcycles, and substantially altered vehicles are excluded.

Your Rights Under Kentucky Law

What The Manufacturer Owes You

Kentucky's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying Elizabethtown case usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Kentucky law and on the paperwork Elizabethtown drivers usually send us.

ELIGIBILITY
It may. Under Ky. Rev. Stat. §367.840 to §367.846, your Elizabethtown car can qualify if a defect covered by the warranty is still there after 4 repair attempts for the same defect, or 30 cumulative calendar days out of service. The statute covers new motor vehicles purchased or leased in Kentucky for personal use.
Ky. Rev. Stat. §367.840 to §367.846 covers new motor vehicles purchased or leased in Kentucky for personal use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
PROCESS & TIMELINE
Usually not. Most lemon law cases we handle for Elizabethtown drivers settle with the manufacturer before a lawsuit is filed. In Kentucky, you must use the manufacturer's arbitration program if it is state-certified. We prepare that filing for you.
REMEDIES
Under Ky. Rev. Stat. §367.840 to §367.846, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Kentucky, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
