How your Kentucky claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Kentucky claim gets built on two things: the Kentucky lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Covington Lemon Law Basics

In Covington, as anywhere else in Kentucky, a lemon law claim is brought under Ky. Rev. Stat. §367.840 to §367.846. The statute covers new motor vehicles purchased or leased in Kentucky for personal use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Kentucky Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Covington Lemon Law Claim Works

This is what happens after you call us from Covington.

1

Document Your Repairs

Keep every repair order from your Covington dealership, even the short ones. Under Kentucky's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Kentucky statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written report of the defect to the manufacturer that Kentucky law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Ky. Rev. Stat. §367.840 to §367.846

Is Your Covington Car a Lemon? Kentucky's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Kentucky law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Kentucky the test is 4 repair attempts for the same defect or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Kentucky, a claim must be filed within 2 years after the date of original delivery of the vehicle to the buyer. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Kenton County

Court and Venue in Covington

Covington is in Kenton County. Kenton County's general civil trial court is the Kenton County Circuit Court, part of the 16th Judicial Circuit. Kentucky also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Kentucky lemon law is Ky. Rev. Stat. §367.840 to §367.846. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The court may award reasonable attorney fees to a plaintiff who prevails.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Some Kentucky rules go beyond the repair test and the arbitration rule covered under Court and Venue above. Those other rules are here.

Notable provisions of Kentucky Lemon Law - Motor Vehicle Warranty Act

Kentucky's coverage window is 12 months or 12,000 miles. The buyer must report the nonconformity to the manufacturer in writing. Motor homes, motorcycles, and substantially altered vehicles are excluded.

Your Rights Under Kentucky Law

What The Manufacturer Owes You

Kentucky law provides for a replacement vehicle or a full refund, minus a reasonable offset for use. There are three ways a qualifying case from Covington usually ends.

$

Refund

Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.

Replacement Vehicle

The manufacturer hands you a comparable new car and pays the cost of the exchange.

$

Cash Settlement

The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Kentucky law and on the paperwork Covington drivers usually send us.

PROCESS & TIMELINE
Most of the Kentucky cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Kentucky, a claim must be filed within 2 years after the date of original delivery of the vehicle to the buyer.
Bring the repair orders from your Covington dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
Ky. Rev. Stat. §367.840 to §367.846 covers new motor vehicles purchased or leased in Kentucky for personal use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
In Kentucky, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Ky. Rev. Stat. §367.840 to §367.846. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Kentucky law. In Kentucky, you must use the manufacturer's arbitration program if it is state-certified.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“I'm not a lawyer, but I tried. I filed complaints with the BBB. I called the manufacturer's customer service line so many times they knew my voice. I even wrote a letter to the dealership owner. Nothing.
My Honda Pilot's fuel system kept throwing check engine codes for the evaporative emissions system. Four visits, four 'fixes,' four returns of the light.
A friend said 'just call a lemon law firm already.' I called Easy Lemon and spoke to Natalie Nassi. First thing she said: 'You've done the hard work already. Now let us do ours.'
She was right. She took my mountain of paperwork—my letters, my complaint case numbers, my repair orders—and organized it into a real claim. The manufacturer settled in two months.
Why them? Natalie valued the effort I'd already put in. She didn't start from zero; she built on my frustration. That respect made all the difference.”

“My Jeep Wrangler's manual transmission would pop out of reverse. Dealer kept it twice, said they couldn't replicate. Third time they replaced the shifter. Still popped out. I was backing out of my driveway and it nearly rolled into the street. Called Easy Lemon and Natalie Nassi said that's a major safety defect. She took my case and Jeep bought it back. Now I drive something that stays in gear.”

“My Ram 2500's check engine light came on for the same evap code four times in six months. Dealer kept replacing gas caps, sensors, the whole runaround. Light would stay off for a week then pop back on. I was so tired of seeing that orange glow on my dash every morning. Called Easy Lemon and they took my service records and ran with it. Four months later, Ram sent a settlement check. No more anxiety every time I start the truck.”
