How your Alabama claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Alabama claim gets built on two things: the Alabama lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Daphne Lemon Law

Daphne Lemon Law Basics

A Daphne car is judged against Alabama's statute, Ala. Code §8-20A-1 to §8-20A-6, and that law covers new motor vehicles purchased or leased in Alabama, used primarily for personal, family, or household purposes. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Alabama Lemon Law Attorneys page.

Step by Step

How a Daphne Lemon Law Claim Works

This is what happens after you call us from Daphne.

1

Document Your Repairs

Keep every repair order from your Daphne dealership, even the short ones. AL lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Alabama statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that AL law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Daphne Car a Lemon? Alabama's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Alabama law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Alabama the test is 3 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Alabama the deadline is 3 years from original delivery. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Baldwin County

Court and Venue in Daphne

Daphne is in Baldwin County. Baldwin County's general civil trial court is the circuit court of Alabama's Twenty-Eighth Judicial Circuit. Alabama also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Alabama lemon law is Ala. Code §8-20A-1 to §8-20A-6. If the manufacturer has a dispute program that follows federal rules, the consumer must use it first.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use allowance). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Alabama Lemon Law: The Rules That Decide a Daphne Claim

Beyond the repair test, the arbitration rule and the deadline, which are all in Court and Venue above, Alabama law has some provisions of its own.

Notable provisions of Alabama Lemon Law

Repair attempts count over the first 24 months or 24,000 miles from original delivery (whichever comes first), and at least one of them must fall within the first year or 12,000 miles. The manufacturer has a final repair opportunity after written notice.

Your Rights Under AL Law

What The Manufacturer Owes You

Alabama's statute lists replacement vehicle or full refund (minus reasonable use allowance). In practice, a qualifying Daphne case under AL law usually ends in one of three ways, and the cards below explain each.

$

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

$

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Alabama law and on the paperwork Daphne drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Daphne dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Daphne drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Alabama rule is: if the manufacturer has a dispute program that follows federal rules, you must use it first. We prepare that filing for you.
REMEDIES
Ala. Code §8-20A-1 to §8-20A-6 provides for replacement vehicle or full refund (minus reasonable use allowance). Which one you get depends on your repair history and on what the manufacturer offers.
In Alabama, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Alabama cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Ala. Code §8-20A-1 to §8-20A-6 requires you to appear anywhere to open a claim. On arbitration, the Alabama rule is: if the manufacturer has a dispute program that follows federal rules, you must use it first.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Ala. Code §8-20A-1 to §8-20A-6. Then written notice goes to the manufacturer, and we demand the statutory remedy, replacement vehicle or full refund (minus reasonable use allowance). Most cases settle at that stage. If a case does not settle, we take the next formal step that Alabama law requires.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”
