Parts of Madison lie in Limestone County and Madison County, per the 2020 Census. Their general civil trial courts are the circuit court of Alabama's Thirty-Ninth Judicial Circuit for Limestone County and the circuit court of Alabama's Twenty-Third Judicial Circuit for Madison County. Alabama also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Alabama lemon law is Ala. Code §8-20A-1 to §8-20A-6. If the manufacturer has a dispute program that follows federal rules, the consumer must use it first.

The statutory remedy is a replacement vehicle or full refund (minus reasonable use allowance). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Alabama Lemon Law: The Rules That Decide a Madison Claim

What The Manufacturer Owes You

Alabama law provides for replacement vehicle or full refund (minus reasonable use allowance). There are three ways a qualifying case from Madison usually ends under AL law.

Refund

Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.

Replacement Vehicle

The manufacturer hands you a comparable new car and pays the cost of the exchange.

Cash Settlement

The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.

When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
