How your Massachusetts claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Massachusetts claim gets built on two things: the Massachusetts lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Boston Lemon Law

Boston Lemon Law Basics

Boston drivers file under Massachusetts's statute, Mass. Gen. Laws ch. 90, §7N½. If the dealer can't fix a warranty defect after 3 repair attempts for the same defect, or the car sits in the shop for 15 cumulative business days, you can ask for a refund, a replacement or a cash payment. The manufacturer can also be ordered to pay your attorney's fees. Statute text, filing deadlines and how used cars are treated are on our Massachusetts Lemon Law Attorneys page.

Is Your Boston Car a Lemon? Massachusetts's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

The defect must materially affect how you drive, how much your vehicle is worth, or how safe it is to operate. In Boston, common qualifying defects include:

  • ⚠️SUSPENSION DAMAGE from Boston's notoriously potholed streets on Commonwealth Avenue, Storrow Drive, and Dorchester Ave
  • ⚠️TRANSMISSION FAILURE from constant stop-and-go on I-93 through the city and the Sumner/Callahan Tunnel approaches
  • ⚠️ELECTRICAL SYSTEM MALFUNCTION from road salt and brine corrosion during 5-month New England winters on city streets
  • ⚠️BRAKE SYSTEM DEFECTS from aggressive braking on narrow Back Bay streets and the rotaries in South Boston
2

Have You Met the Repair Attempt Threshold?

Massachusetts's Lemon Law triggers when any of these conditions are met, so long as you bring your claim within the first 15,000 miles or 1 year after original delivery (whichever comes first):

3️⃣ 3 repair attempts for the same defect at an authorized dealership
📅 15 cumulative business days out of service for any combination of defects
3

Did It Happen Within the Rights Period?

The clock starts on the day you take delivery of your vehicle, not when you first report the defect, not when you file a complaint. Under Massachusetts law, a claim must generally be brought within the first 15,000 miles or 1 year after original delivery (whichever comes first). If you're still within that window, or if your defect first appeared within the window and persists, you almost certainly qualify.

When in doubt, call. The consultation is always free. 📞 (855) 435-3666

Boston Driving Environment

Boston Driving Conditions & Why Defects Emerge Here

Boston's coastal location creates a uniquely challenging environment for motor vehicles. Salt air, humidity, and bridge crossings all contribute to accelerated wear and defects.

🗺️ Local Driving Demands

Boston drivers navigate demanding corridors including I-90, I-93, and US-1 daily. Higher mileage from daily commuting influences the usage offset in lemon law claims. The earlier you report defects, the lower your offset and the stronger your case.

🌉 The Bridge Factor

The major bridge and highway infrastructure including the Zakim Bridge, the Longfellow Bridge, and the Tobin Memorial Bridge create load profiles that expose transmission hesitation and engine defects flat-road driving conceals. Clients report vehicles that "drive fine on flat roads" but exhibit problems under load.

🌊 Coastal & Salt Air Exposure

Boston's coastal location exposes vehicles to salt-laden air and humidity year-round. Salt corrosion attacks electrical connectors invisibly, causing intermittent faults that dealers can't "duplicate." Our attorneys document these coastal damage patterns.

🌡️ Climate Stress on Vehicles

Boston's seasonal temperature range, from summer highs to winter lows, creates thermal cycling that stresses HVAC, cooling, and electrical systems over time. Massachusetts's Lemon Law recognizes these climate-related failures as a substantial impairment.

🚗 Heavy Commuter Traffic

Boston's major traffic corridors including I-90, I-93, and US-1 create heavy stop-and-go conditions that stress transmission fluid temperatures, cooling systems, and hybrid/EV battery management. These could qualify as lemon law defects.

Frequently Asked Questions

Everything you need to know about filing a lemon law claim in Boston, Massachusetts.

ELIGIBILITY
Under Mass. Gen. Laws ch. 90, §7N½, your car may qualify if a warranty-covered defect survives 3 repair attempts for the same defect, or 15 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in Massachusetts for personal, family, or household use.
Mass. Gen. Laws ch. 90, §7N½ covers a nonconformity: a defect that substantially impairs the use, market value or safety of the vehicle and that survives 3 repair attempts for the same defect, or keeps the car out of service for 15 cumulative business days. It applies to new motor vehicles purchased or leased in Massachusetts for personal, family, or household use. One Massachusetts-specific point: Massachusetts has a strong lemon law — only 15 business days out-of-service and 3 repair attempts. The defects we file most often for Massachusetts drivers are engine stalling and misfires, transmission shudder or failure, electrical faults that leave warning lights on, brake and steering problems, and driver-assistance (ADAS) systems that brake or drift on their own.
REMEDIES
Under Mass. Gen. Laws ch. 90, §7N½, the statutory remedy is replacement vehicle or full refund (minus reasonable use offset). Which one applies depends on your repair history and the manufacturer.
In Massachusetts, the manufacturer pays the consumer's attorney's fees when the consumer wins. Mass. Gen. Laws ch. 90, §7N½ is the statute a Massachusetts court applies, and the federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Easy Lemon takes Massachusetts cases on contingency: nothing upfront, and no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fees on top of what you receive, replacement vehicle or full refund (minus reasonable use offset). Read the fee terms before you sign anything; ours fit on one page, and you can ask us to walk through them on the first call.
ATTORNEY & TRUST
No. Nothing in Mass. Gen. Laws ch. 90, §7N½ requires you to appear anywhere to open a claim; on arbitration, the Massachusetts rule is: state-run arbitration through the Office of Consumer Affairs. Easy Lemon's offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX, and we run Massachusetts cases by phone, email and e-signature: an intake call, a document upload (repair orders, purchase or lease contract, warranty booklet), a written demand to the manufacturer, then settlement paperwork. What you should watch instead of a calendar of appointments is the clock: the Massachusetts filing deadline is within the first 15,000 miles or 1 year after original delivery (whichever comes first). Start the file as soon as you are near 3 repair attempts for the same defect.
You will have one assigned attorney and a direct line, and the case moves through fixed stages you can check against. First we confirm the Mass. Gen. Laws ch. 90, §7N½ thresholds on your repair history (3 repair attempts for the same defect, or 15 cumulative business days out of service). Next comes written notice to the manufacturer (the Massachusetts arbitration rule: state-run arbitration through the Office of Consumer Affairs). Then the demand for the statutory remedy, replacement vehicle or full refund (minus reasonable use offset). Most cases settle at that stage; if one does not, we file suit: the Massachusetts filing deadline is within the first 15,000 miles or 1 year after original delivery (whichever comes first). You get a copy of every letter we send and a note whenever the manufacturer responds.

What Our Clients Are Saying

Easy Lemon has handled 1,500+ lemon law matters.

My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.

My Dodge Challenger's AC would blow hot air on the driver side but cold on passenger. Dealer recharged it twice, replaced a blend door actuator once. Problem came back every time. I was sweating through my shirt in August. Called Easy Lemon and Aaron Waldo said a climate control issue that makes driving uncomfortable counts. His team fought Dodge and got me a cash settlement. Got it fixed at a local shop and the AC has been cold ever since.
