Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

How your Maine claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Maine claim gets built on two things: the Maine lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Westbrook Lemon Law Basics
In Westbrook, as anywhere else in Maine, a lemon law claim is brought under Me. Rev. Stat. tit. 10, §1161 to §1169. The statute covers new motor vehicles purchased or leased in Maine, including the chassis of motor homes, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Maine Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Is Your Westbrook Car a Lemon? Maine's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Maine law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Maine the test is 3 repair attempts for the same defect or a reasonable number of attempts, or 15 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Maine, you must request state arbitration within 3 years from original delivery or the express warranty term, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in Westbrook
Westbrook is in Cumberland County. Cumberland County's general civil trial court is the Cumberland County Superior Court. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Maine lemon law is Me. Rev. Stat. tit. 10, §1161 to §1169. The claim must go through the Maine Motor Vehicle Arbitration Board, which the state administers.
The repair test in the statute is 3 repair attempts for the same defect (or a reasonable number of attempts), or 15 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The court may award a consumer who prevails reasonable attorney fees and costs, and it must award them when the consumer prevails on an appeal of a state arbitration decision.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Maine Lemon Law: The Rules That Decide a Westbrook Claim
The Maine repair test and arbitration rule are under Court and Venue above, so they are not repeated here. This section adds a few more rules from Maine law.
Notable provisions of Maine Lemon Law
Maine counts only 15 business days out of service, and you have up to 3 years from delivery (or the warranty term, if that ends first) to request state arbitration. Arbitration is state-run, not manufacturer-run, and the law also covers the chassis of motor homes.

What The Manufacturer Owes You
Maine law provides for a replacement vehicle or a full refund, minus a reasonable offset for use. There are three ways a qualifying case from Westbrook usually ends.
Refund
Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.
Replacement Vehicle
The manufacturer hands you a comparable new car and pays the cost of the exchange.
Cash Settlement
The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.
