How your Maine claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Maine claim gets built on two things: the Maine lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Auburn Lemon Law

Auburn Lemon Law Basics

The law that applies in Auburn is Maine's lemon law, Me. Rev. Stat. tit. 10, §1161 to §1169, and it covers new motor vehicles purchased or leased in Maine, including the chassis of motor homes. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Maine Lemon Law Attorneys page.

Step by Step

How an Auburn Lemon Law Claim Works

This is what happens after you call us from Auburn.

1

Document Your Repairs

Keep every repair order from your Auburn dealership, even the short ones. Under Maine's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Maine statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Auburn Car a Lemon? Maine's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Maine law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Maine the test is 3 repair attempts for the same defect or a reasonable number of attempts, or 15 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Maine, you must request state arbitration within 3 years from original delivery or the express warranty term, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Androscoggin County

Court and Venue in Auburn

Auburn is in Androscoggin County. Androscoggin County's general civil trial court is the Androscoggin County Superior Court. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Maine lemon law is Me. Rev. Stat. tit. 10, §1161 to §1169. The claim must go through the Maine Motor Vehicle Arbitration Board, which the state administers.

The repair test in the statute is 3 repair attempts for the same defect (or a reasonable number of attempts), or 15 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The court may award a consumer who prevails reasonable attorney fees and costs, and it must award them when the consumer prevails on an appeal of a state arbitration decision.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Maine Lemon Law: The Rules That Decide an Auburn Claim

Looking for the repair test or the arbitration rule? Those are under Court and Venue above. Maine law has a few more rules, and they are listed here.

Notable provisions of Maine Lemon Law

Maine counts only 15 business days out of service, and you have up to 3 years from delivery (or the warranty term, if that ends first) to request state arbitration. Arbitration is state-run, not manufacturer-run, and the law also covers the chassis of motor homes.

Your Rights Under Maine Law

What The Manufacturer Owes You

Under the statute, the remedy open to Maine drivers is a replacement vehicle or a full refund, minus a reasonable offset for use. If your Auburn car qualifies, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Frequently Asked Questions

The answers below are based on Maine law and on the paperwork Auburn drivers usually send us.

PROCESS & TIMELINE
Most of the Maine cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Maine, you must request state arbitration within 3 years from original delivery or the express warranty term, whichever comes first.
Bring the repair orders from your Auburn dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
REMEDIES
Under Me. Rev. Stat. tit. 10, §1161 to §1169, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
In Maine, the court may award a consumer who prevails reasonable attorney fees and costs, and it must award them when the consumer prevails on an appeal of a state arbitration decision. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Maine cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Me. Rev. Stat. tit. 10, §1161 to §1169 requires you to appear anywhere to open a claim.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Me. Rev. Stat. tit. 10, §1161 to §1169. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Maine law. In Maine, you must use state-administered arbitration through the Maine Motor Vehicle Arbitration Board. It is run by the state, not by the manufacturer.

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”

“My Dodge Challenger's AC would blow hot air on the driver side but cold on passenger. Dealer recharged it twice, replaced a blend door actuator once. Problem came back every time. I was sweating through my shirt in August. Called Easy Lemon and Aaron Waldo said a climate control issue that makes driving uncomfortable counts. His team fought Dodge and got me a cash settlement. Got it fixed at a local shop and the AC has been cold ever since.”
