Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders, and we handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your Arkansas claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Arkansas claim gets built on two things: the Arkansas lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

West Memphis Lemon Law Basics
In West Memphis, as anywhere else in Arkansas, a lemon law claim is brought under Ark. Code §4-90-401 to §4-90-417. The statute covers new motor vehicles purchased or leased in Arkansas, primarily for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Arkansas Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

We File the Claim
We write and send the paperwork, including any written notice to the manufacturer that AR law requires. We deal with the manufacturer for you.
You Get Compensated
The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your West Memphis Car a Lemon? Arkansas's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Arkansas law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Arkansas the test is 3 repair attempts for the same defect (or 1 for life-threatening defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Arkansas the deadline is 24 months or 24,000 miles from original delivery (whichever is earlier). We check it against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in West Memphis
West Memphis is in Crittenden County. Crittenden County's general civil trial court is the Crittenden County Circuit Court, part of the Second Judicial Circuit. Arkansas also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Arkansas lemon law is Ark. Code §4-90-401 to §4-90-417. Arbitration is voluntary in Arkansas and is not required before filing suit.
The repair test in the statute is 3 repair attempts for the same defect (or 1 for life-threatening defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use allowance). A consumer who prevails can recover reasonable attorney fees.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Arkansas New Motor Vehicle Quality Assurance Act: The Rules That Decide a West Memphis Claim
Beyond the repair test, the arbitration rule and the deadline, which are all in Court and Venue above, Arkansas law has some provisions of its own.
Notable provisions of Arkansas New Motor Vehicle Quality Assurance Act
One repair attempt is sufficient for defects likely to cause death or serious bodily injury. Covers vehicles up to 10,000 lbs GVWR.

What The Manufacturer Owes You
Under Arkansas law the remedy is replacement vehicle or full refund (minus reasonable use allowance). A qualifying AR case from West Memphis usually closes in one of these three ways.
Refund
The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.
Replacement Vehicle
The manufacturer swaps your car for a comparable new one and pays for the exchange.
Cash Settlement
You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.
