How your Arkansas claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Arkansas claim gets built on two things: the Arkansas lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Conway Lemon Law

Conway Lemon Law Basics

Conway drivers file under Arkansas's statute, Ark. Code §4-90-401 to §4-90-417. If the dealer can't fix a warranty defect after 3 repair attempts for the same defect (or 1 for life-threatening defects), or the car sits in the shop for 30 cumulative calendar days, you can ask for a refund, a replacement or a cash payment. The manufacturer can also be ordered to pay your attorney's fees. Statute text, filing deadlines and how used cars are treated are on our Arkansas Lemon Law Attorneys page.

Is Your Conway Car a Lemon? Arkansas's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

The defect must materially affect how you drive, how much your vehicle is worth, or how safe it is to operate. In Conway, common qualifying defects include:

  • ⚠️TRANSMISSION PROBLEMS from heavy I-40 commercial truck traffic and stop-and-go on Oak Street through the college district
  • ⚠️AC SYSTEM FAILURE from 100°F Faulkner County summers with high humidity while stuck in college-town traffic
  • ⚠️SUSPENSION DAMAGE from potholes and rough railroad crossings on Prince Street and Oak Street through downtown Conway
  • ⚠️ELECTRICAL SYSTEM FAILURE from tornado-alley severe weather and flash flooding in the Arkansas River Valley
2

Have You Met the Repair Attempt Threshold?

Arkansas's Lemon Law triggers when any of these conditions are met, so long as you bring your claim within 24 months or 24,000 miles from original delivery (whichever is earlier):

3️⃣ 3 repair attempts for the same defect (or 1 for life-threatening defects) at an authorized dealership
1️⃣ 1 repair attempt for a defect that could cause serious bodily injury or death
📅 30 cumulative calendar days out of service for any combination of defects
3

Did It Happen Within the Rights Period?

The clock starts on the day you take delivery of your vehicle, not when you first report the defect, not when you file a complaint. Under Arkansas law, a claim must generally be brought within 24 months or 24,000 miles from original delivery (whichever is earlier). If you're still within that window, or if your defect first appeared within the window and persists, you almost certainly qualify.

Conway Driving Environment

Conway Driving Conditions & Why Defects Emerge Here

Conway's intense heat and humidity combination is one of the most punishing vehicle environments in America. Here is how local conditions contribute to defects.

🗺️ Local Driving Demands

Conway drivers navigate demanding corridors including I-40, US-65, US-64, and AR-25 daily. Higher mileage from daily commuting influences the usage offset in lemon law claims. The earlier you report defects, the lower your offset and the stronger your case.

🌉 The Bridge Factor

The major bridge and highway infrastructure including the I-40/US-65 interchange and the Cadron Creek Bridge on US-64 create load profiles that expose transmission hesitation and engine defects flat-road driving conceals. Clients report vehicles that "drive fine on flat roads" but exhibit problems under load.

🌡️ Heat & Humidity Damage

Conway's combination of high heat and humidity creates a punishing environment for vehicles. Moisture infiltrates electrical connections causing intermittent faults, HVAC systems run under extreme load, and heat cycles stress engine gaskets and seals.

🌡️ Sustained Heat & Humidity

Conway's prolonged heat and humidity create sustained stress on HVAC compressors, cooling systems, and electrical wiring. Moisture-driven corrosion accelerates component failure faster than in dry climates. Arkansas's Lemon Law recognizes these failures as a substantial impairment.

🚗 Heavy Commuter Traffic

Conway's major traffic corridors including I-40, US-65, US-64, and AR-25 create heavy stop-and-go conditions that stress transmission fluid temperatures, cooling systems, and hybrid/EV battery management. These could qualify as lemon law defects.

Frequently Asked Questions

Everything you need to know about filing a lemon law claim in Conway, Arkansas.

PROCESS & TIMELINE
The clock under Ark. Code §4-90-401 to §4-90-417 starts with the repair history: 3 repair attempts for the same defect (or 1 for life-threatening defects), or 30 cumulative calendar days out of service. Once your repair orders show that, Easy Lemon sends the written demand to the manufacturer; most Arkansas cases settle at that stage without a lawsuit. The Arkansas filing deadline is within 24 months or 24,000 miles from original delivery (whichever is earlier).
Every repair order from your Conway dealership, the purchase or lease contract and the warranty booklet. Under Ark. Code §4-90-401 to §4-90-417 the claim rests on those repair orders: 3 repair attempts for the same defect (or 1 for life-threatening defects), or 30 cumulative calendar days out of service. The Arkansas filing deadline is within 24 months or 24,000 miles from original delivery (whichever is earlier).
ELIGIBILITY
Ark. Code §4-90-401 to §4-90-417 covers new motor vehicles purchased or leased in Arkansas, primarily for personal, family, or household use.
REMEDIES
In Arkansas, the manufacturer pays the consumer's attorney's fees when the consumer wins. Ark. Code §4-90-401 to §4-90-417 is the statute a Arkansas court applies, and the federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Easy Lemon takes Arkansas cases on contingency: nothing upfront, and no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fees on top of what you receive, replacement vehicle or full refund (minus reasonable use allowance). Read the fee terms before you sign anything; ours fit on one page, and you can ask us to walk through them on the first call.
ATTORNEY & TRUST
Nothing upfront and no hourly bills. We work on contingency, so there is no attorney's fee unless we recover for you. In Arkansas, the manufacturer pays the consumer's attorney's fees when the consumer wins. That is why most Arkansas claims that succeed end with the manufacturer, not the driver, covering our fee. Repair orders come from the dealer for free, and we cover filing costs while the matter is open. If your car qualifies under Ark. Code §4-90-401 to §4-90-417 (3 repair attempts for the same defect (or 1 for life-threatening defects), or 30 cumulative calendar days out of service), the money at stake is the remedy itself, replacement vehicle or full refund (minus reasonable use allowance). Bring the repair orders to the free case review and we will tell you which of those remedies fits.
You will have one assigned attorney and a direct line, and the case moves through fixed stages you can check against. First we confirm the Ark. Code §4-90-401 to §4-90-417 thresholds on your repair history (3 repair attempts for the same defect (or 1 for life-threatening defects), or 30 cumulative calendar days out of service). Next comes written notice to the manufacturer (the Arkansas arbitration rule: arbitration is voluntary, not required before filing suit). Then the demand for the statutory remedy, replacement vehicle or full refund (minus reasonable use allowance). Most cases settle at that stage; if one does not, we file suit: the Arkansas filing deadline is within 24 months or 24,000 miles from original delivery (whichever is earlier). You get a copy of every letter we send and a note whenever the manufacturer responds.

I had a good experience with Easy lemon. I had bought a used truck that had transmission issues before I even got it home. After a year of the dealership giving me the runaround, I reached out to Easy Lemon. It was a drawn out process dealing with the vehicle manufacturer. We got it done and I am happy with the results. Thanks to Vanessa, Antonio, Fabio, and the rest of the team that made this possible.
