How your Washington claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Washington claim gets built on two things: the Washington lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Spokane Valley Lemon Law

Spokane Valley Lemon Law Basics

Claims from Spokane Valley fall under Wash. Rev. Code §19.118.005 to §19.118.911, which covers new motor vehicles purchased or leased in Washington for personal, family, or household use (includes motorcycles). If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Washington Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How a Spokane Valley Lemon Law Claim Works

This is what happens after you call us from Spokane Valley.

1

Document Your Repairs

Keep every repair order from your Spokane Valley dealership, even the short ones. WA lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Washington statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that WA law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Spokane Valley Car a Lemon? Washington's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Washington law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Washington cases:

  • ⚠️2024 Audi Q5 e (Plug-In Hybrid): Recurring wireless Apple CarPlay disconnects
  • ⚠️2024 Audi Q5 e (Plug-In Hybrid): MMI infotainment screen randomly going dark / blanking during driving
  • ⚠️2024 Audi Q5 e (Plug-In Hybrid): Wireless charging pad overheating during normal use
2

Have You Met the Repair Attempt Threshold?

In Washington the test is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 2 repair attempts are enough. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Washington the deadline is 30 months from the date of original delivery. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Spokane County

Court and Venue in Spokane Valley

Spokane Valley is in Spokane County. The Washington Courts directory lists the Spokane County Superior Court as the county's superior court. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Washington lemon law is Wash. Rev. Code §19.118.005 to §19.118.911. The claim must go through state-certified arbitration run by the Washington Attorney General's office.

The repair test in the statute is 4 repair attempts for the same defect (or 2 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle, full refund, or restitution. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What the Statute Says

Washington Lemon Law - Motor Vehicle Warranty Enforcement: The Rules That Decide a Spokane Valley Claim

Washington law sets a repair test, an arbitration rule and a deadline, and Court and Venue above already explains those three. Here are a few of its other rules.

Notable provisions of Washington Lemon Law - Motor Vehicle Warranty Enforcement

Washington’s eligibility period ends 2 years after original delivery or at the first 24,000 miles, whichever occurs first; a consumer may request state-administered arbitration up to 30 months from original delivery. Only 2 diagnosis or repair attempts are needed for a serious safety defect. Also covers motorcycles.

Your Rights Under WA Law

What The Manufacturer Owes You

The Washington statute provides for replacement vehicle, full refund, or restitution, and a qualifying WA case from Spokane Valley usually ends in one of these three ways.

$

Refund

You hand back the car. In return the manufacturer repays the price, the taxes, the registration fees and the finance charges.

Replacement Vehicle

You leave with a comparable new car. The manufacturer pays for the swap.

$

Cash Settlement

You keep the car, and the manufacturer pays you for the value the defect took off it. This result is not listed in the statute and comes from negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Washington law and on the paperwork Spokane Valley drivers usually send us.

PROCESS & TIMELINE
Most of the Washington cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. The Washington filing deadline is within 30 months from the date of original delivery.
Bring the repair orders from your Spokane Valley dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Spokane Valley drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Washington rule is: must use state-certified arbitration through the Washington Attorney General's office. We prepare that filing for you.
ELIGIBILITY
Wash. Rev. Code §19.118.005 to §19.118.911 covers new motor vehicles purchased or leased in Washington for personal, family, or household use (includes motorcycles). If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle any warranty defect that substantially impairs the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own. Washington’s eligibility period ends 2 years after original delivery or at the first 24,000 miles, whichever occurs first; a consumer may request state-administered arbitration up to 30 months from original delivery.
REMEDIES
In Washington, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.

What Our Clients Are Saying

Easy Lemon has handled 1,500+ lemon law matters‡.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”
