Under Arizona law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in Easy Lemon's own Arizona cases:

Maricopa County

Court and Venue in Scottsdale

Scottsdale is in Maricopa County. Maricopa County's general civil trial court is the Superior Court in Maricopa County. Arizona also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Arizona lemon law is Ariz. Rev. Stat. §44-1261 to §44-1267. The Arizona presumption applies only after the manufacturer itself gets prior direct written notice (A.R.S. §44-1264(C)); the statute names no delivery method. If the manufacturer has a dispute program that follows federal FTC rules, the consumer must use it first.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use allowance). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

What The Manufacturer Owes You

Arizona's statute lists replacement vehicle or full refund (minus reasonable use allowance). In practice, a qualifying Scottsdale case under AZ law usually ends in one of three ways, and the cards below explain each.

Refund

You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.

Replacement Vehicle

You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.

Cash Settlement

The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.

In Arizona, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
