How your Oregon claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Oregon claim gets built on two things: the Oregon lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Oregon City Lemon Law

Oregon City Lemon Law Basics

The law that applies in Oregon City is Oregon's lemon law, Or. Rev. Stat. §646A.400 to §646A.418, and it covers new motor vehicles purchased or leased in Oregon for personal, family, or household use. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Oregon Lemon Law Attorneys page.

Step by Step

How an Oregon City Lemon Law Claim Works

This is what happens after you call us from Oregon City.

1

Document Your Repairs

Keep every repair order from your Oregon City dealership, even the short ones. Under Oregon's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Oregon statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Oregon law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Oregon City Car a Lemon? Oregon's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Oregon law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Oregon the test is 3 repair attempts for the same defect or 30 cumulative calendar days out of service (60 days for motor homes), as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Oregon, a claim must be brought within 1 year after the earlier of 2 years or 24,000 miles from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Clackamas County

Court and Venue in Oregon City

Oregon City is in Clackamas County. Clackamas County's general civil trial court is the Clackamas County Circuit Court, part of the 5th Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Oregon lemon law is Or. Rev. Stat. §646A.400 to §646A.418. If the manufacturer has a dispute program that follows federal FTC rules and has told the consumer about it, the consumer must use it first; its decision binds the manufacturer but not the consumer.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days (60 days for motor homes) with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, the court may award reasonable attorney fees to a consumer who prevails.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Oregon Lemon Law: The Rules That Decide an Oregon City Claim

Court and Venue above gives you the repair test and the arbitration rule. Oregon law adds a few rules on top of those, and they follow.

Notable provisions of Oregon Lemon Law

Oregon covers 2 years/24,000 miles and counts calendar days for out-of-service. Written notice to the manufacturer is required.

Your Rights Under Oregon Law

What The Manufacturer Owes You

What the manufacturer owes under Oregon's statute is a replacement vehicle or a full refund, minus a reasonable offset for use. Most qualifying cases from Oregon City end in one of the three results below.

$

Refund

The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.

Replacement Vehicle

You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.

$

Cash Settlement

You keep driving the car and the manufacturer pays you for the lost value. This is a negotiated result, since the statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on Oregon law and on the paperwork Oregon City drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Oregon City dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under Or. Rev. Stat. §646A.400 to §646A.418, your Oregon City car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect, or 30 cumulative calendar days (60 days for motor homes) out of service. The statute covers new motor vehicles purchased or leased in Oregon for personal, family, or household use.
Or. Rev. Stat. §646A.400 to §646A.418 covers new motor vehicles purchased or leased in Oregon for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Oregon cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Or. Rev. Stat. §646A.400 to §646A.418 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. In Oregon, a consumer who wins may recover attorney's fees from the manufacturer. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

“I honestly didn't think I had a case. My Subaru's engine consumed a quart of oil every 1,000 miles. Dealer said it was 'within spec.' Did that three times. I just figured I'd live with it.
My brother-in-law, a mechanic, said 'that's not normal for a modern engine. Call someone.' So I did. I spoke to Steven Nassi at Easy Lemon.
He explained that excessive oil consumption is a known defect in certain Subaru engines. He'd handled similar cases. He said, 'They tell you it's normal because they don't want to replace the short block.' He already knew the internal service bulletins.
His team filed the claim. Subaru settled with a cash payment that covered my oil expenses and then some. I was genuinely surprised it worked.
Why different? Steven saw a pattern I didn't know existed. They don't just take cases; they know manufacturer secrets.”

“My Tesla Model Y had three things wrong that the service center couldn't fix: 1) Phantom braking on highway. 2) Passenger door handle wouldn't present half the time. 3) Rattling from the rear seat area they blamed on 'road noise.' I had service invoices showing four attempts on the brakes, two on the handle, and three on the rattle. Called Easy Lemon. Aaron Waldo took it. He didn't treat them as three small problems. He argued they collectively impaired the vehicle's safety and value. Manufacturer settled with a cash payout plus extended warranty on the remaining issues. They bundle your headaches into one real case."”
