Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

How your Oregon claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Oregon claim gets built on two things: the Oregon lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Bend Lemon Law Basics
A Bend car is judged against Oregon's statute, Or. Rev. Stat. §646A.400 to §646A.418, and that law covers new motor vehicles purchased or leased in Oregon for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Oregon Lemon Law Attorneys page.
How a Bend Lemon Law Claim Works
This is what happens after you call us from Bend.
Document Your Repairs
Keep every repair order from your Bend dealership, even the short ones. Under Oregon's lemon law, those papers are the written proof of each repair attempt.
Free Case Evaluation
We read your repair history against the Oregon statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including the written notice to the manufacturer that Oregon law requires. We deal with the manufacturer for you.
You Get Compensated
A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your Bend Car a Lemon? Oregon's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Oregon law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Oregon the test is 3 repair attempts for the same defect or 30 cumulative calendar days out of service (60 days for motor homes), as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Oregon, a claim must be brought within 1 year after the earlier of 2 years or 24,000 miles from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in Bend
Bend is in Deschutes County. Deschutes County's general civil trial court is the Deschutes County Circuit Court, part of the 11th Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Oregon lemon law is Or. Rev. Stat. §646A.400 to §646A.418. If the manufacturer has a dispute program that follows federal FTC rules and has told the consumer about it, the consumer must use it first; its decision binds the manufacturer but not the consumer.
The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days (60 days for motor homes) with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, the court may award reasonable attorney fees to a consumer who prevails.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

The Oregon repair test and arbitration rule are under Court and Venue above, so they are not repeated here. This section adds a few more rules from Oregon law.
Notable provisions of Oregon Lemon Law
Oregon covers 2 years/24,000 miles and counts calendar days for out-of-service. Written notice to the manufacturer is required.

What The Manufacturer Owes You
Oregon's statute lists a replacement vehicle or a full refund, minus a reasonable offset for use. In practice, a qualifying Bend case usually ends in one of three ways, and the cards below explain each.
Refund
You return the car. The price comes back to you, and so do the taxes, the registration fees and the finance charges, after a reasonable use offset is taken off.
Replacement Vehicle
You trade the defective car for a comparable new one, and the manufacturer pays what the swap costs.
Cash Settlement
The car stays with you, and the manufacturer pays for the drop in value the defect caused. The statute does not provide for this. It comes out of negotiation.
