How your Oregon claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Oregon claim gets built on two things: the Oregon lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Newberg Lemon Law

Newberg Lemon Law Basics

Oregon's lemon law, Or. Rev. Stat. §646A.400 to §646A.418, is the one that applies in Newberg. It covers new motor vehicles purchased or leased in Oregon for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Oregon Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Newberg Lemon Law Claim Works

This is what happens after you call us from Newberg.

1

Document Your Repairs

Keep every repair order from your Newberg dealership, even the short ones. Under Oregon's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Oregon statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Oregon law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Newberg Car a Lemon? Oregon's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Oregon law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Oregon the test is 3 repair attempts for the same defect or 30 cumulative calendar days out of service (60 days for motor homes), as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Oregon, a claim must be brought within 1 year after the earlier of 2 years or 24,000 miles from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Yamhill County

Court and Venue in Newberg

Newberg is in Yamhill County. Yamhill County's general civil trial court is the Yamhill County Circuit Court, part of the 25th Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Oregon lemon law is Or. Rev. Stat. §646A.400 to §646A.418. If the manufacturer has a dispute program that follows federal FTC rules and has told the consumer about it, the consumer must use it first; its decision binds the manufacturer but not the consumer.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days (60 days for motor homes) with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, the court may award reasonable attorney fees to a consumer who prevails.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Oregon Lemon Law: The Rules That Decide a Newberg Claim

We covered the repair test and the arbitration rule in the Court and Venue section above. Below are other Oregon rules that can matter to a Newberg claim.

Notable provisions of Oregon Lemon Law

Oregon covers 2 years/24,000 miles and counts calendar days for out-of-service. Written notice to the manufacturer is required.

Your Rights Under Oregon Law

What The Manufacturer Owes You

Oregon law provides for a replacement vehicle or a full refund, minus a reasonable offset for use. There are three ways a qualifying case from Newberg usually ends.

$

Refund

Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.

Replacement Vehicle

The manufacturer hands you a comparable new car and pays the cost of the exchange.

$

Cash Settlement

The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Oregon law and on the paperwork Newberg drivers usually send us.

PROCESS & TIMELINE
Most of the Oregon cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Oregon, a claim must be brought within 1 year after the earlier of 2 years or 24,000 miles from original delivery.
Bring the repair orders from your Newberg dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Newberg drivers settle with the manufacturer before a lawsuit is filed. In Oregon, if the manufacturer has a dispute program that follows federal FTC rules and told you about it, you must use it first. Its decision binds the manufacturer but not you. We prepare that filing for you.
ELIGIBILITY
It may. Under Or. Rev. Stat. §646A.400 to §646A.418, your Newberg car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect, or 30 cumulative calendar days (60 days for motor homes) out of service. The statute covers new motor vehicles purchased or leased in Oregon for personal, family, or household use.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Oregon cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Or. Rev. Stat. §646A.400 to §646A.418 requires you to appear anywhere to open a claim.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Or. Rev. Stat. §646A.400 to §646A.418. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Oregon law. In Oregon, if the manufacturer has a dispute program that follows federal FTC rules and told you about it, you must use it first. Its decision binds the manufacturer but not you.
