How your Oklahoma claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Oklahoma claim gets built on two things: the Oklahoma lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Muskogee Lemon Law

Muskogee Lemon Law Basics

Oklahoma's lemon law, Okla. Stat. tit. 15, §901 to §910, is the one that applies in Muskogee. It covers new motor vehicles purchased or leased in Oklahoma for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our Oklahoma Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Muskogee Lemon Law Claim Works

This is what happens after you call us from Muskogee.

1

Document Your Repairs

Keep every repair order from your Muskogee dealership, even the short ones. Under Oklahoma's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Oklahoma statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer that Oklahoma law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Muskogee Car a Lemon? Oklahoma's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Oklahoma law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Oklahoma the test is 4 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Oklahoma, the deadline under the statute is the express warranty period or 1 year from delivery, whichever is earlier. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you think you are past a deadline, call us anyway. We may still be able to help.

Muskogee County

Court and Venue in Muskogee

Muskogee is in Muskogee County. Muskogee County's general civil trial court is the Muskogee County District Court. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Oklahoma lemon law is Okla. Stat. tit. 15, §901 to §910. If the manufacturer's arbitration program is state-certified, the consumer must use it.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Some Oklahoma rules go beyond the repair test and the arbitration rule covered under Court and Venue above. Those other rules are here.

Notable provisions of Oklahoma Motor Vehicle Quality Assurance Act

Oklahoma requires 4 repair attempts. Written notice to the manufacturer is required, and the manufacturer is given one final repair opportunity. The law covers vehicles during the original warranty period.

Your Rights Under Oklahoma Law

What The Manufacturer Owes You

Oklahoma law provides for a replacement vehicle or a full refund, minus a reasonable offset for use. There are three ways a qualifying case from Muskogee usually ends.

$

Refund

Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.

Replacement Vehicle

The manufacturer hands you a comparable new car and pays the cost of the exchange.

$

Cash Settlement

The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Oklahoma law and on the paperwork Muskogee drivers usually send us.

PROCESS & TIMELINE
Most of the Oklahoma cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Oklahoma, the deadline under the statute is the express warranty period or 1 year from delivery, whichever is earlier.
Bring the repair orders from your Muskogee dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
In Oklahoma, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Oklahoma, a consumer who wins may recover attorney's fees from the manufacturer. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Okla. Stat. tit. 15, §901 to §910. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by Oklahoma law. In Oklahoma, you must use the manufacturer's arbitration program first if it is state-certified.
