Do You Qualify?
Four questions will help you find out in about a minute.
You Likely Qualify!
Your answers meet the basic lemon law test. Before anyone can confirm that your car qualifies, an attorney has to see the repair orders. We work on a contingency basis, and there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
The standard lemon law test does not seem to fit. Other consumer protection laws may still help with a car like yours. Contact us anyway.

How your Iowa claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Iowa claim gets built on two things: the Iowa lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Dubuque Lemon Law Basics
In Dubuque, as anywhere else in Iowa, a lemon law claim is brought under Iowa Code §322G.1 to §322G.15. The statute covers new motor vehicles purchased or leased in Iowa for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our Iowa Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.
How a Dubuque Lemon Law Claim Works
This is what happens after you call us from Dubuque.
Document Your Repairs
Keep every repair order from your Dubuque dealership, even the short ones. Under Iowa's lemon law, those papers are the written proof of each repair attempt.
Free Case Evaluation
We read your repair history against the Iowa statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.
We File the Claim
We write and send the paperwork, including the written notice to the manufacturer that Iowa law requires. We deal with the manufacturer for you.
You Get Compensated
A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.
Is Your Dubuque Car a Lemon? Iowa's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Iowa law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Iowa the test is 3 repair attempts for the same defect (1 for serious safety defects) or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. For a defect that could cause serious bodily injury or death, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Iowa, a claim must be filed within 1 year from the expiration of the lemon law rights period, which ends 2 years after original delivery or at 24,000 miles, whichever comes first. We check that deadline against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you think you are past a deadline, call us anyway. We may still be able to help.
Court and Venue in Dubuque
Dubuque is in Dubuque County. Dubuque County's general civil trial court is the Iowa District Court for Dubuque County, in Judicial District 1. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Iowa lemon law is Iowa Code §322G.1 to §322G.15. Arbitration is voluntary in Iowa.
The repair test in the statute is 3 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Iowa Lemon Law: The Rules That Decide a Dubuque Claim
Iowa law sets a repair test and says whether arbitration comes first, and Court and Venue above already explains both. Here are a few of its other rules.
Notable provisions of Iowa Lemon Law
Iowa counts calendar days and requires 3 repair attempts. One attempt is sufficient for defects causing death or serious injury. Written notice to the manufacturer is required.

What The Manufacturer Owes You
What the manufacturer owes under Iowa's statute is a replacement vehicle or a full refund, minus a reasonable offset for use. Most qualifying cases from Dubuque end in one of the three results below.
Refund
The manufacturer takes the car back and pays you the purchase price, taxes, registration fees and finance charges, and it can subtract a reasonable use offset.
Replacement Vehicle
You get a comparable new car in place of the one with the defect, with the manufacturer covering the cost.
Cash Settlement
You keep driving the car and the manufacturer pays you for the lost value. This is a negotiated result, since the statute does not list it.
