Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

How your Tennessee claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Tennessee claim gets built on two things: the Tennessee lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Clarksville Lemon Law Basics
A Clarksville car is judged against Tennessee's statute, Tenn. Code §55-24-101 to §55-24-112, and that law covers new motor vehicles purchased or leased in Tennessee for personal, family, or household use. So the first question is coverage, and the second is whether your repair orders reach one of the repair limits in the box above. If they do, and the defect is still there and the deadline has not run out, you may have a claim. The statute text, the filing deadlines and how used cars are treated are all on our Tennessee Lemon Law Attorneys page.

Is Your Clarksville Car a Lemon? Tennessee's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Tennessee law, the defect has to substantially impair the vehicle's use, value, or safety.
Have You Met the Repair Attempt Threshold?
In Tennessee the test is 3 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
In Tennessee the deadline is 6 months following the later of the express warranty term expiring or 1 year from original delivery. We check it against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in Clarksville
Clarksville is in Montgomery County. Montgomery County has its own Circuit Court, and Circuit Courts are courts of general jurisdiction in Tennessee. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Tennessee lemon law is Tenn. Code §55-24-101 to §55-24-112. If the manufacturer's arbitration program is state-certified, the consumer must use it.
The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Tennessee Motor Vehicle Warranty Enforcement Act: The Rules That Decide a Clarksville Claim
The Tennessee repair test, arbitration rule and deadline are under Court and Venue above, so they are not repeated here. This section adds a few more rules from Tennessee law.
Notable provisions of Tennessee Motor Vehicle Warranty Enforcement Act
Tennessee requires 3 repair attempts, or 30 cumulative calendar days out of service, within the term of protection — the express warranty or 1 year from delivery, whichever comes first. Written notice to the manufacturer by certified mail is required, after which the manufacturer has up to 10 days to cure. Tenn. Code ch. 55-24 provides no reduced-attempt route for safety-related defects.

What The Manufacturer Owes You
Tennessee law provides for replacement vehicle or full refund (minus reasonable use offset). There are three ways a qualifying case from Clarksville usually ends under TN law.
Refund
Give the car back and the manufacturer repays the price you paid, with the taxes, registration fees and finance charges. A reasonable use offset comes off that amount.
Replacement Vehicle
The manufacturer hands you a comparable new car and pays the cost of the exchange.
Cash Settlement
The car stays yours and the manufacturer pays for the value the defect took off it. You will not find this option in the statute. It is reached by negotiation.
