Common Questions

Frequently Asked Questions

Can I file a lemon law claim for a Mercedes-Benz E 350?
Yes. Mercedes-Benz vehicles, including the E 350, are covered by state lemon laws and the federal Magnuson-Moss Warranty Act when they qualify. If your Mercedes-Benz E 350 has a substantial defect — such as an instrument cluster screen and navigation command screen that both went black, an audio sound system that intermittently cuts in and out with loss of volume and theme control, a navigation touchscreen that was unresponsive or freezing, a climate control system that would not change temperature at times and would freeze, or a command screen that intermittently freezes or goes completely blank and is very hot to the touch — that authorized service cannot permanently repair after a reasonable number of attempts, or it has been out of service for an extended period, it may qualify as a lemon. The court may award reasonable attorney fees if you prevail, and you pay nothing out of pocket†.
What is the New York Lemon Law?
New York’s Lemon Law (N.Y. Gen. Bus. Law § 198-a) protects consumers who buy or lease new motor vehicles that have substantial defects covered by warranty. A vehicle may qualify if the manufacturer or its authorized agents have made a reasonable number of repair attempts for the same nonconformity (generally four or more attempts for the same defect), or if the vehicle has been out of service by reason of repair for 30 or more cumulative days, within the first 2 years or 18,000 miles. Consumers may also pursue claims under the federal Magnuson-Moss Warranty Act for vehicles still under the manufacturer’s written warranty.
What does a Vehicle Buyback mean in a lemon law case?
A Vehicle Buyback is the strongest outcome in a lemon law case. The manufacturer repurchases the defective vehicle and typically refunds the purchase or lease price (including taxes, registration, and financing costs) minus a reasonable use allowance based on mileage before the first repair. The manufacturer takes the vehicle back, and the consumer is made whole.
How does Easy Lemon handle Mercedes-Benz lemon law claims?
Easy Lemon files a formal demand against Mercedes-Benz citing the applicable state lemon law and the federal Magnuson-Moss Warranty Act. We handle the documentation, communication with the manufacturer, negotiation, and arbitration or litigation when necessary. Our clients pay nothing out of pocket; the court may award reasonable attorney fees if you prevail†.
