How your Utah claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Utah claim gets built on two things: the Utah lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Salt Lake City Lemon Law

Salt Lake City Lemon Law Basics

The law that applies in Salt Lake City is Utah's lemon law, Utah Code §13-20-1 to §13-20-8, and it covers new motor vehicles purchased or leased in Utah for personal, family, or household use. You may have a claim if your repair orders reach one of the repair limits in the box above while the defect is still there and you are inside the deadline. The statute text, the filing deadlines and the rules on used cars are on our Utah Lemon Law Attorneys page.

Step by Step

How a Salt Lake City Lemon Law Claim Works

This is what happens after you call us from Salt Lake City.

1

Document Your Repairs

Keep every repair order from your Salt Lake City dealership, even the short ones. UT lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the Utah statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that UT law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Utah Code §13-20-1 to §13-20-8

Is Your Salt Lake City Car a Lemon? Utah's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Utah law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Utah cases:

  • ⚠️2024 Dodge Charger Daytona: Recurring Service Electrical System message
  • ⚠️2024 Dodge Charger Daytona: Persistent Uconnect Box error
  • ⚠️2024 Dodge Charger Daytona: Warning Light Illumination Unavailable + Service Required dashboard alerts
  • ⚠️2024 Dodge Charger Daytona: Uconnect Box recurrence
2

Have You Met the Repair Attempt Threshold?

In Utah the test is 4 repair attempts for the same defect, or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Utah the deadline is the earlier of the warranty period or 2 years from delivery. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Salt Lake County

Court and Venue in Salt Lake City

Salt Lake City is in Salt Lake County. Salt Lake County's general civil trial court is the Third Judicial District Court. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Utah lemon law is Utah Code §13-20-1 to §13-20-8. Arbitration is available in Utah but not mandatory.

The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). A consumer who prevails may recover attorney fees.

What the Statute Says

Utah New Motor Vehicle Warranties Act: The Rules That Decide a Salt Lake City Claim

Beyond the repair test, the arbitration rule and the deadline, which are all in Court and Venue above, Utah law has some provisions of its own.

Notable provisions of Utah New Motor Vehicle Warranties Act

Utah requires 4 repair attempts and uses business days. Written notice to manufacturer required. No mandatory arbitration, making it easier to pursue litigation.

Your Rights Under UT Law

What The Manufacturer Owes You

The Utah statute provides for replacement vehicle or full refund (minus reasonable use offset), and a qualifying UT case from Salt Lake City usually ends in one of these three ways.

$

Refund

You hand back the car. In return the manufacturer repays the price, the taxes, the registration fees and the finance charges, with a reasonable use offset taken out.

Replacement Vehicle

You leave with a comparable new car. The manufacturer pays for the swap.

$

Cash Settlement

You keep the car, and the manufacturer pays you for the value the defect took off it. This result is not listed in the statute and comes from negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on Utah law and on the paperwork Salt Lake City drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Salt Lake City dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
Usually not. Most lemon law cases we handle for Salt Lake City drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Utah rule is: arbitration is available but not mandatory.
REMEDIES
Utah Code §13-20-1 to §13-20-8 provides for replacement vehicle or full refund (minus reasonable use offset). Which one you get depends on your repair history and on what the manufacturer offers.
In Utah, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. In Utah, a consumer who wins may recover attorney's fees from the manufacturer. In most successful Utah claims, the manufacturer pays our fee. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against Utah Code §13-20-1 to §13-20-8. Then written notice goes to the manufacturer, and we demand the statutory remedy, replacement vehicle or full refund (minus reasonable use offset). Most cases settle at that stage. If a case does not settle, we take the next formal step that Utah law requires.
