How your Maryland claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Maryland claim gets built on two things: the Maryland lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Salisbury Lemon Law

Salisbury Lemon Law Basics

Salisbury drivers file under Maryland's statute, Md. Code, Com. Law §14-1501 to §14-1504. If the dealer can't fix a warranty defect after 4 repair attempts for the same defect (or 1 for serious safety defects), or the car sits in the shop for 30 cumulative calendar days, you can ask for a refund, a replacement or a cash payment. The manufacturer can also be ordered to pay your attorney's fees. Statute text, filing deadlines and how used cars are treated are on our Maryland Lemon Law Attorneys page.

Is Your Salisbury Car a Lemon? Maryland's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

The defect must materially affect how you drive, how much your vehicle is worth, or how safe it is to operate. In Salisbury, common qualifying defects include:

  • ⚠️PAINT AND CORROSION DAMAGE from Delmarva Peninsula salt air and coastal humidity year-round
  • ⚠️AC/COOLING FAILURE from overworked cooling systems in hot, humid Eastern Shore summers exceeding 95°F
  • ⚠️ELECTRICAL SYSTEM MALFUNCTION from coastal moisture and nor\'easter storms that flood low-lying roads near the Wicomico River
  • ⚠️SUSPENSION DAMAGE from rough surfaces on US-13 through town and agricultural truck damage on MD-349
2

Have You Met the Repair Attempt Threshold?

Maryland's Lemon Law triggers when any of these conditions are met, so long as you bring your claim within 3 years from the date of original delivery:

4️⃣ 4 repair attempts for the same defect (or 1 for serious safety defects) at an authorized dealership
1️⃣ 1 repair attempt for a defect that could cause serious bodily injury or death
📅 30 cumulative calendar days out of service for any combination of defects
3

Did It Happen Within the Rights Period?

The clock starts on the day you take delivery of your vehicle, not when you first report the defect, not when you file a complaint. Under Maryland law, a claim must generally be brought within 3 years from the date of original delivery. If you're still within that window, or if your defect first appeared within the window and persists, you almost certainly qualify.

Salisbury Driving Environment

Salisbury Driving Conditions & Why Defects Emerge Here

Salisbury's coastal location creates a uniquely challenging environment for motor vehicles. Salt air, humidity, and bridge crossings all contribute to accelerated wear and defects.

🗺️ Local Driving Demands

Salisbury drivers navigate demanding corridors including US-13, US-50, and MD-349 daily. Higher mileage from daily commuting influences the usage offset in lemon law claims. The earlier you report defects, the lower your offset and the stronger your case.

🌉 The Bridge Factor

The major bridge and highway infrastructure including the US-50 Wicomico River Bridge and the US-13 overpass at the Salisbury Bypass create load profiles that expose transmission hesitation and engine defects flat-road driving conceals. Clients report vehicles that "drive fine on flat roads" but exhibit problems under load.

🌊 Coastal & Salt Air Exposure

Salisbury's coastal location exposes vehicles to salt-laden air and humidity year-round. Salt corrosion attacks electrical connectors invisibly, causing intermittent faults that dealers can't "duplicate." Our attorneys document these coastal damage patterns.

🌡️ Climate Stress on Vehicles

Salisbury's seasonal temperature range, from summer highs to winter lows, creates thermal cycling that stresses HVAC, cooling, and electrical systems over time. Maryland's Lemon Law recognizes these climate-related failures as a substantial impairment.

🚗 Heavy Commuter Traffic

Salisbury's major traffic corridors including US-13, US-50, and MD-349 create heavy stop-and-go conditions that stress transmission fluid temperatures, cooling systems, and hybrid/EV battery management. These could qualify as lemon law defects.

What the Statute Says

Maryland Lemon Law - Maryland Automobile Warranty Enforcement Act: The Rules That Decide a Salisbury Claim

Repair-attempt presumption in Maryland

4 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service.

Arbitration before suit

Yes - must use manufacturer's arbitration if it meets state standards.

Filing deadline

Within 3 years from the date of original delivery.

Notable provisions of Maryland Lemon Law - Maryland Automobile Warranty Enforcement Act

Maryland’s manufacturer’s warranty period runs the earlier of the first 18,000 miles of operation or 24 months from original delivery. A single repair attempt suffices where the defect causes failure of the braking or steering system and, after notice and an opportunity to cure, the repair still does not bring the vehicle into compliance with the State motor vehicle safety inspection laws. Written notice to the manufacturer is required by certified mail, return receipt requested.

Frequently Asked Questions

Everything you need to know about filing a lemon law claim in Salisbury, Maryland.

PROCESS & TIMELINE
The clock under Md. Code, Com. Law §14-1501 to §14-1504 starts with the repair history: 4 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service. Once your repair orders show that, Easy Lemon sends the written demand to the manufacturer; most Maryland cases settle at that stage without a lawsuit. The Maryland filing deadline is within 3 years from the date of original delivery.
Most lemon law cases we handle for Salisbury drivers settle with the manufacturer before a lawsuit is filed. On arbitration, the Maryland rule is: must use manufacturer's arbitration if it meets state standards. We prepare that filing for you.
ELIGIBILITY
Md. Code, Com. Law §14-1501 to §14-1504 covers new motor vehicles purchased, leased, or registered in Maryland for personal, family, or household use.
REMEDIES
Under Md. Code, Com. Law §14-1501 to §14-1504, the statutory remedy is replacement vehicle or full refund (minus reasonable use offset). Which one applies depends on your repair history and the manufacturer.
ATTORNEY & TRUST
Nothing upfront and no hourly bills. We work on contingency, so there is no attorney's fee unless we recover for you. In Maryland, the manufacturer pays the consumer's attorney's fees when the consumer wins. That is why most Maryland claims that succeed end with the manufacturer, not the driver, covering our fee. Repair orders come from the dealer for free, and we cover filing costs while the matter is open. If your car qualifies under Md. Code, Com. Law §14-1501 to §14-1504 (4 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service), the money at stake is the remedy itself, replacement vehicle or full refund (minus reasonable use offset). Bring the repair orders to the free case review and we will tell you which of those remedies fits.
You will have one assigned attorney and a direct line, and the case moves through fixed stages you can check against. First we confirm the Md. Code, Com. Law §14-1501 to §14-1504 thresholds on your repair history (4 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative calendar days out of service). Next comes written notice to the manufacturer (the Maryland arbitration rule: must use manufacturer's arbitration if it meets state standards). Then the demand for the statutory remedy, replacement vehicle or full refund (minus reasonable use offset). Most cases settle at that stage; if one does not, we file suit: the Maryland filing deadline is within 3 years from the date of original delivery. You get a copy of every letter we send and a note whenever the manufacturer responds.

I had a good experience with Easy lemon. I had bought a used truck that had transmission issues before I even got it home. After a year of the dealership giving me the runaround, I reached out to Easy Lemon. It was a drawn out process dealing with the vehicle manufacturer. We got it done and I am happy with the results. Thanks to Vanessa, Antonio, Fabio, and the rest of the team that made this possible.

I’m so grateful for Easy Lemon, they live up to their name! The process was easy and clean of understanding what angle they would approach as well as what your options could be. Staff very professional, responsive and helpful GREAT! They was able to get a buy back option for me and my car not brand new or money back and keeping my vehicle. I’m so helpful for them without them I would be stuck with a vehicle I just purchased with very expensive over 10k of work needed to be done which I would’ve pay out of pocket for! I high recommend EASY LEMON!
