How your New Hampshire claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A New Hampshire claim gets built on two things: the New Hampshire lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Nashua Lemon Law

Nashua Lemon Law Basics

In Nashua, as anywhere else in New Hampshire, a lemon law claim is brought under N.H. Rev. Stat. §357-D:1 to §357-D:10. The statute covers new motor vehicles purchased or leased in New Hampshire for personal, family, or household use, but being covered is only the start. The car also has to reach one of the repair limits in the box above, with the defect still unrepaired and the deadline not yet passed. If it does, you may have a claim. Our New Hampshire Lemon Law Attorneys page goes through the statute text, the filing deadlines and used cars in more detail.

Step by Step

How a Nashua Lemon Law Claim Works

This is what happens after you call us from Nashua.

1

Document Your Repairs

Keep every repair order from your Nashua dealership, even the short ones. NH lemon law needs written proof of each repair attempt, and those papers are the proof.

2

Free Case Evaluation

We read your repair history against the New Hampshire statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including any written notice to the manufacturer that NH law requires. We deal with the manufacturer for you.

4

You Get Compensated

The case ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

N.H. Rev. Stat. §357-D:1 to §357-D:10

Is Your Nashua Car a Lemon? New Hampshire's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under New Hampshire law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In New Hampshire the test is 3 repair attempts for the same defect, or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In New Hampshire the deadline is the warranty period. We check it against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you are past the deadline, call us anyway. We may still be able to help.

Hillsborough County

Court and Venue in Nashua

Nashua is in Hillsborough County, which has two Superior Court locations assigned by town. The New Hampshire Judicial Branch's town list sends Nashua to Hillsborough County Superior Court South, the county's general civil trial court for that town. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The New Hampshire lemon law is N.H. Rev. Stat. §357-D:1 to §357-D:10. The claim must go through the New Hampshire Motor Vehicle Arbitration Board, which the state runs.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). Under the statute, a consumer who prevails can recover attorney fees from the manufacturer.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

New Hampshire Lemon Law: The Rules That Decide a Nashua Claim

We covered the repair test, the arbitration rule and the deadline in the Court and Venue section above. Below are other New Hampshire rules that can matter to a Nashua claim.

Notable provisions of New Hampshire Lemon Law

New Hampshire uses state-run arbitration (not manufacturer-run). Only 3 repair attempts required. Manufacturer must clearly disclose lemon law buyback history when reselling.

Your Rights Under NH Law

What The Manufacturer Owes You

The New Hampshire statute provides for replacement vehicle or full refund (minus reasonable use offset), and a qualifying NH case from Nashua usually ends in one of these three ways.

$

Refund

You hand back the car. In return the manufacturer repays the price, the taxes, the registration fees and the finance charges, with a reasonable use offset taken out.

Replacement Vehicle

You leave with a comparable new car. The manufacturer pays for the swap.

$

Cash Settlement

You keep the car, and the manufacturer pays you for the value the defect took off it. This result is not listed in the statute and comes from negotiation.

Have Questions?

Frequently Asked Questions

The answers below are based on New Hampshire law and on the paperwork Nashua drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Nashua dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
It may. Under N.H. Rev. Stat. §357-D:1 to §357-D:10, your Nashua car can qualify if a defect covered by the warranty is still there after 3 repair attempts for the same defect, or 30 cumulative business days out of service. The statute covers new motor vehicles purchased or leased in New Hampshire for personal, family, or household use.
REMEDIES
N.H. Rev. Stat. §357-D:1 to §357-D:10 provides for replacement vehicle or full refund (minus reasonable use offset). Which one you get depends on your repair history and on what the manufacturer offers.
In New Hampshire, the manufacturer pays the consumer's attorney's fees when the consumer wins. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle New Hampshire cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in N.H. Rev. Stat. §357-D:1 to §357-D:10 requires you to appear anywhere to open a claim. On arbitration, the New Hampshire rule is: must use state-run arbitration through the New Hampshire Motor Vehicle Arbitration Board.
Nothing upfront, and no attorney's fee unless we recover for you. In New Hampshire, the manufacturer pays the consumer's attorney's fees when the consumer wins. In most successful New Hampshire claims, the manufacturer pays our fee. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
