Under Minnesota law, the defect has to substantially impair the vehicle's use, value, or safety.

In Minnesota the test is 4 repair attempts for the same defect (1 for serious safety defects) or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. For a complete failure of the braking or steering system likely to cause death or serious bodily injury, 1 repair attempt is enough. Count the visits on your repair orders to see where you stand.

Did It Happen Within the Rights Period?

In Minnesota, a claim must be filed within 3 years from the date of original delivery, or within 6 months after the decision if you used the manufacturer's dispute program within those 3 years. We check that deadline against the delivery date on your contract and the dates on your repair orders.

Court and Venue in Minneapolis

Minneapolis is in Hennepin County. Hennepin County's general civil trial court is the Hennepin County District Court, part of the Fourth Judicial District. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Minnesota lemon law is Minn. Stat. §325F.665. If the manufacturer's arbitration program is certified and available, the consumer must use it.

The repair test in the statute is 4 repair attempts for the same defect (or 1 for serious safety defects), or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable allowance for use. A consumer who prevails may recover attorney fees.

Minnesota Lemon Law: The Rules That Decide a Minneapolis Claim

Beyond the repair test and the arbitration rule, which are both in Court and Venue above, Minnesota law has some provisions of its own.

Notable provisions of Minnesota Lemon Law

Minnesota's presumption applies only if the manufacturer, its agent, or its authorized dealer received prior written notification from or on behalf of the consumer at least once and an opportunity to cure. One repair attempt is sufficient where the nonconformity results in a complete failure of the braking or steering system likely to cause death or serious bodily injury. Minnesota counts business days for out-of-service.

What The Manufacturer Owes You

Under the statute, the remedy open to Minnesota drivers is a replacement vehicle or a full refund, minus a reasonable allowance for use. If your Minneapolis car qualifies, the case usually ends in one of the three ways below.

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Minn. Stat. §325F.665 covers new motor vehicles purchased or leased in Minnesota for personal, family, or household purposes. If you bought used, send the paperwork anyway, including any written warranty that came with the car.

The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.

REMEDIES

In Minnesota, a consumer who wins may recover attorney's fees from the manufacturer. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) adds a second fee-shifting route when a written warranty is breached. Our fee agreement is one page.
