How your North Dakota claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A North Dakota claim gets built on two things: the North Dakota lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Grand Forks Lemon Law

Grand Forks Lemon Law Basics

North Dakota's lemon law, N.D. Cent. Code §51-07-16 to §51-07-22, is the one that applies in Grand Forks. It covers new motor vehicles purchased or leased in North Dakota for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our North Dakota Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Grand Forks Lemon Law Claim Works

This is what happens after you call us from Grand Forks.

1

Document Your Repairs

Keep every repair order from your Grand Forks dealership, even the short ones. Under North Dakota's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the North Dakota statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the prior direct notice to the manufacturer that North Dakota law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Grand Forks Car a Lemon? North Dakota's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under North Dakota law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In North Dakota the test is 4 or more repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In North Dakota, a claim must be brought within 6 months after the earlier of the express warranty term expiring or 18 months from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Grand Forks County

Court and Venue in Grand Forks

Grand Forks is in Grand Forks County. Grand Forks County's general civil trial court is the District Court, Grand Forks County (Northeast Central Judicial District). Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The North Dakota lemon law is N.D. Cent. Code §51-07-16 to §51-07-22. The refund or replacement remedy is not available until the consumer has first used the manufacturer's qualifying informal dispute program.

The repair test in the statute is 4 or more repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The North Dakota lemon law has no attorney-fee provision of its own.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

North Dakota Lemon Law: The Rules That Decide a Grand Forks Claim

Beyond the repair test and the arbitration rule, which are both in Court and Venue above, North Dakota law has some provisions of its own.

Notable provisions of North Dakota Lemon Law

North Dakota's presumption requires more than three repair attempts — that is, four or more — or 30 business days out of service. Prior direct notice to the manufacturer and an opportunity to cure are required.

Your Rights Under North Dakota Law

What The Manufacturer Owes You

Under the statute, the remedy open to North Dakota drivers is a replacement vehicle or a full refund, minus a reasonable offset for use. If your Grand Forks car qualifies, the case usually ends in one of the three ways below.

$

Refund

You return the car and the manufacturer pays back the price, taxes, registration fees and finance charges, minus a reasonable use offset.

Replacement Vehicle

The manufacturer replaces the car with a comparable new one at its own cost.

$

Cash Settlement

You keep the car and receive a payment for its lost value. That payment is negotiated. The statute does not list it.

Have Questions?

Frequently Asked Questions

The answers below are based on North Dakota law and on the paperwork Grand Forks drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Grand Forks dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
N.D. Cent. Code §51-07-16 to §51-07-22 covers new motor vehicles purchased or leased in North Dakota for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
The North Dakota lemon law has no attorney-fee provision of its own. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) provides a fee-shifting route of its own when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. The North Dakota lemon law has no attorney-fee provision of its own. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against N.D. Cent. Code §51-07-16 to §51-07-22. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by North Dakota law. In North Dakota, you cannot get a replacement or refund unless you first use the manufacturer's qualifying informal dispute settlement procedure.

What Our Clients Are Saying

Easy Lemon has handled 3,000+ lemon law cases‡.

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”

“My Honda Pilot's backup camera would go black right when I needed it. Dealer replaced it once. Broke again. Replaced it again. Third time they said 'they're working on it.' I have kids, I need that camera. Called Easy Lemon and Natalie Nassi said a safety feature failing repeatedly counts. She filed the claim and Honda settled with cash. Got it fixed at an independent shop and pocketed the rest. Camera's been fine since.”

“My Dodge Challenger's AC would blow hot air on the driver side but cold on passenger. Dealer recharged it twice, replaced a blend door actuator once. Problem came back every time. I was sweating through my shirt in August. Called Easy Lemon and Aaron Waldo said a climate control issue that makes driving uncomfortable counts. His team fought Dodge and got me a cash settlement. Got it fixed at a local shop and the AC has been cold ever since.”
