How your North Dakota claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A North Dakota claim gets built on two things: the North Dakota lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Bismarck Lemon Law

Bismarck Lemon Law Basics

North Dakota's lemon law, N.D. Cent. Code §51-07-16 to §51-07-22, is the one that applies in Bismarck. It covers new motor vehicles purchased or leased in North Dakota for personal, family, or household use. You may have a claim once your repair orders reach one of the repair limits in the box above, as long as the defect is still there and you are inside the deadline. Our North Dakota Lemon Law Attorneys page has the full statute text, the filing deadlines and the used-car rules.

Step by Step

How a Bismarck Lemon Law Claim Works

This is what happens after you call us from Bismarck.

1

Document Your Repairs

Keep every repair order from your Bismarck dealership, even the short ones. Under North Dakota's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the North Dakota statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the prior direct notice to the manufacturer that North Dakota law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Is Your Bismarck Car a Lemon? North Dakota's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under North Dakota law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In North Dakota the test is 4 or more repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In North Dakota, a claim must be brought within 6 months after the earlier of the express warranty term expiring or 18 months from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Burleigh County

Court and Venue in Bismarck

Bismarck is in Burleigh County. Burleigh County's general civil trial court is the District Court, Burleigh County (South Central Judicial District). Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The North Dakota lemon law is N.D. Cent. Code §51-07-16 to §51-07-22. The refund or replacement remedy is not available until the consumer has first used the manufacturer's qualifying informal dispute program.

The repair test in the statute is 4 or more repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The North Dakota lemon law has no attorney-fee provision of its own.

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

North Dakota Lemon Law: The Rules That Decide a Bismarck Claim

Some North Dakota rules go beyond the repair test and the arbitration rule covered under Court and Venue above. Those other rules are here.

Notable provisions of North Dakota Lemon Law

North Dakota's presumption requires more than three repair attempts — that is, four or more — or 30 business days out of service. Prior direct notice to the manufacturer and an opportunity to cure are required.

Your Rights Under North Dakota Law

What The Manufacturer Owes You

Under North Dakota law the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A qualifying case from Bismarck usually closes in one of these three ways.

$

Refund

The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.

Replacement Vehicle

The manufacturer swaps your car for a comparable new one and pays for the exchange.

$

Cash Settlement

You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.

Have Questions?

Frequently Asked Questions

The answers below are based on North Dakota law and on the paperwork Bismarck drivers usually send us.

PROCESS & TIMELINE
Bring the repair orders from your Bismarck dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
ELIGIBILITY
N.D. Cent. Code §51-07-16 to §51-07-22 covers new motor vehicles purchased or leased in North Dakota for personal, family, or household use. If you bought used, send the paperwork anyway, including any written warranty that came with the car.
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
REMEDIES
The North Dakota lemon law has no attorney-fee provision of its own. We work on contingency, so you pay nothing upfront and there is no attorney's fee unless we recover for you. When a manufacturer settles or loses, we ask it to pay our fee on top of your recovery. The federal Magnuson-Moss Warranty Act (15 U.S.C. §2310(d)) provides a fee-shifting route of its own when a written warranty is breached. Our fee agreement is one page.
ATTORNEY & TRUST
Nothing upfront, and no attorney's fee unless we recover for you. The North Dakota lemon law has no attorney-fee provision of its own. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.
You will have one assigned attorney and a direct line. You get a copy of every letter we send and a note whenever the manufacturer responds. We first check your repair history against N.D. Cent. Code §51-07-16 to §51-07-22. Then written notice goes to the manufacturer, and we demand the statutory remedy, a replacement vehicle or a full refund, minus a reasonable offset for use. Most cases settle at that stage. If a case does not settle, the next step is set by North Dakota law. In North Dakota, you cannot get a replacement or refund unless you first use the manufacturer's qualifying informal dispute settlement procedure.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”
