Do You Qualify?
About a minute is all it takes to find out. There are four questions.
You Likely Qualify!
So far your answers fit the basic lemon law test. An attorney has to confirm it from the repair orders. We handle cases on a contingency basis, which means no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers do not fit the standard lemon law test, but other consumer protection laws might still apply. Contact us anyway.

How your South Carolina claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A South Carolina claim gets built on two things: the South Carolina lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Court and Venue in Bluffton
Bluffton is in Beaufort County. Beaufort County's general civil trial court is the Court of Common Pleas, the civil side of the circuit court in the Fourteenth Judicial Circuit. South Carolina also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The South Carolina lemon law is S.C. Code §56-28-10 to §56-28-100. If the manufacturer's arbitration program is state-certified, the consumer must use it.
The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A consumer who prevails may recover attorney fees.
Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

Notable provisions of South Carolina Lemon Law - Defective Motor Vehicle Act

What The Manufacturer Owes You
Under South Carolina law the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. A qualifying case from Bluffton usually closes in one of these three ways.
Refund
The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.
Replacement Vehicle
The manufacturer swaps your car for a comparable new one and pays for the exchange.
Cash Settlement
You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.
