How your Alaska claim gets built

Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. An Alaska claim gets built on two things: the Alaska lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Anchorage Lemon Law

Anchorage Lemon Law Basics

Claims from Anchorage fall under Alaska Stat. §45.45.300 to §45.45.360, which covers new motor vehicles purchased or leased in Alaska for personal, family, or household use. If the defect is still there once your repair orders reach one of the repair limits in the box above, and you are within the deadline, you may have a claim. Our Alaska Lemon Law Attorneys page has the statute text, the deadlines and the used-car rules.

Step by Step

How an Anchorage Lemon Law Claim Works

This is what happens after you call us from Anchorage.

1

Document Your Repairs

Keep every repair order from your Anchorage dealership, even the short ones. Under Alaska's lemon law, those papers are the written proof of each repair attempt.

2

Free Case Evaluation

We read your repair history against the Alaska statute and tell you whether the car qualifies. The review costs nothing, and there are no attorney's fees unless we recover for you.

3

We File the Claim

We write and send the paperwork, including the written notice to the manufacturer by certified mail that Alaska law requires. We deal with the manufacturer for you.

4

You Get Compensated

A successful case usually ends with a refund, a replacement vehicle or a cash settlement. There are no attorney's fees unless we recover for you.

Alaska Stat. §45.45.300 to §45.45.360

Is Your Anchorage Car a Lemon? Alaska's 3-Step Test

1

Does the Defect Substantially Impair Use, Value, or Safety?

Under Alaska law, the defect has to substantially impair the vehicle's use, value, or safety.

2

Have You Met the Repair Attempt Threshold?

In Alaska the test is 3 repair attempts for the same defect or 30 cumulative business days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.

3

Did It Happen Within the Rights Period?

In Alaska, the deadline is the written notice deadline under AS 45.45.310: within 60 days after the earlier of the express warranty expiring or 1 year from original delivery. We check that deadline against the delivery date on your contract and the dates on your repair orders.

If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666

If you think you are past a deadline, call us anyway. We may still be able to help.

Anchorage Municipality

Court and Venue in Anchorage

Alaska has boroughs, not counties, and the Census lists Anchorage as Anchorage Municipality. Its general civil trial court is the Alaska Superior Court, Third Judicial District at Anchorage. Alaska also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.

The Alaska lemon law is Alaska Stat. §45.45.300 to §45.45.360. Alaska's lemon law sets no arbitration step before a lawsuit.

The repair test in the statute is 3 repair attempts for the same defect, or 30 cumulative business days with the vehicle out of service. The statutory remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. The Alaska lemon law has no attorney-fee provision of its own. A manufacturer that refuses a required refund or replacement is presumed to have committed an unfair trade practice, and a plaintiff who prevails in that kind of action is awarded full reasonable attorney fees (AS 45.50.537(a)).

Open recalls on your vehicle can be checked against NHTSA records at easylemon.com/recalls. A recall alone is not a lemon law claim.

What the Statute Says

Alaska Lemon Law: The Rules That Decide an Anchorage Claim

Alaska law sets a repair test and says whether arbitration comes first, and Court and Venue above already explains both. Here are a few of its other rules.

Notable provisions of Alaska Lemon Law

Alaska counts business days, not calendar days, for the out-of-service calculation. The manufacturer must be given written notice and a final repair opportunity.

Your Rights Under Alaska Law

What The Manufacturer Owes You

By statute, the Alaska remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. When an Anchorage car qualifies under Alaska law, the case usually ends in one of three ways.

$

Refund

The manufacturer buys the car back. It repays the price along with the taxes, registration fees and finance charges, but it may deduct a reasonable use offset.

Replacement Vehicle

Instead of money you get a comparable new car, and the swap costs you nothing.

$

Cash Settlement

The statute does not set this one. It comes from negotiation: you keep the car, and the manufacturer pays for the value the defect took off it.

Have Questions?

Frequently Asked Questions

The answers below are based on Alaska law and on the paperwork Anchorage drivers usually send us.

PROCESS & TIMELINE
Most of the Alaska cases we handle settle at the written-demand stage, without a lawsuit. How long that takes depends on your repair history and on the manufacturer. In Alaska, the deadline is the written notice deadline under AS 45.45.310: within 60 days after the earlier of the express warranty expiring or 1 year from original delivery.
Bring the repair orders from your Anchorage dealer, your purchase or lease contract and your warranty booklet. Of the three, the repair orders carry the case. Each one shows the date, the mileage and what the service department did or did not fix. If a few are missing, ask the service desk for copies.
REMEDIES
Under Alaska Stat. §45.45.300 to §45.45.360, the remedy is a replacement vehicle or a full refund, minus a reasonable offset for use. Which one you get depends on your repair history and on what the manufacturer offers.
ELIGIBILITY
We handle warranty defects that substantially impair the car's use, value or safety and that the dealer could not fix. The defects we see most often are engine stalling and misfires, transmission shudder or failure, electrical faults, brake and steering problems, and driver-assist systems that brake or drift on their own.
ATTORNEY & TRUST
No. Our offices are in Manhasset NY, Newark NJ, Miami FL and Dallas TX. We handle Alaska cases by phone, email and e-signature. You upload your repair orders, your contract and your warranty booklet. We send the demand letter and handle the settlement paperwork. Nothing in Alaska Stat. §45.45.300 to §45.45.360 requires you to appear anywhere to open a claim.
Nothing upfront, and no attorney's fee unless we recover for you. When a manufacturer settles, we ask it to pay our fee on top of your recovery. Repair orders are free from the dealer. We pay the filing costs while the case is open. To start, send us the repair orders for a free case review.

“Wasn't sure I had a case because my problem seemed small. But it was constant. Same thing over and over. The service manager started avoiding me. Called Easy Lemon just to see. They said send your records. I did. Next thing I know, the manufacturer is offering a settlement. Not small at all. Glad I didn't talk myself out of calling.”

“My Dodge Challenger's fuel gauge would read empty when the tank was full. Dealer replaced the sending unit, then the whole fuel pump assembly. Same problem. I ran out of gas twice because I thought I had fuel. Stupid design. Called Easy Lemon and they said a safety feature like fuel gauge failing is a big deal. They fought Dodge and got me a buyback. New car doesn't lie to me about how much gas I have.”
