Do You Qualify?
It takes about a minute. Four questions, and you find out if the lemon law may apply.
You Likely Qualify!
Your answers line up with the basic lemon law test. The next step is for an attorney to confirm that from your repair orders. Because we work on a contingency basis, there are no attorney’s fees unless we recover for you.
You May Not Qualify Under Standard Lemon Law
Your answers fall outside the usual lemon law test. That does not rule out other consumer protection laws. Contact us anyway.

How your Michigan claim gets built
Our lemon law work is directed by Steven P. Nassi, Esq., Managing Partner, Easy Lemon by RockPoint Law P.C. A Michigan claim gets built on two things: the Michigan lemon law statute, and the federal Magnuson-Moss Warranty Act, which applies in all fifty states. Send the repair orders and the purchase or lease paperwork, and we can tell you which of the two fits your vehicle.

Laws §257.1401 to §257.1410, and it covers new motor vehicles purchased or leased in Michigan, primarily for personal, family, or household use. The statute text, the filing deadlines and the rules on used cars are on our Michigan Lemon Law Attorneys page.

Is Your Warren Car a Lemon? Michigan's 3-Step Test
Does the Defect Substantially Impair Use, Value, or Safety?
Under Michigan law, the defect has to substantially impair the vehicle's use, value, or safety. These defects came up in one of Easy Lemon's own Michigan cases:
- ⚠️2024 Kia EV9: High-voltage battery failure
- ⚠️2024 Kia EV9: Front motor MCU inverter failure
- ⚠️2024 Kia EV9: Complete electric power loss
- ⚠️2024 Kia EV9: Steering column lockup
Have You Met the Repair Attempt Threshold?
In Michigan the test is 4 repair attempts for the same defect, or 30 cumulative calendar days out of service, as long as the claim is brought within the deadline in step 3. Count the visits on your repair orders to see where you stand.
Did It Happen Within the Rights Period?
The Michigan lemon law does not set its own deadline to sue, but defects must first be reported within the express warranty term or 1 year from delivery, whichever is earlier. We check it against the delivery date on your contract and the dates on your repair orders.
If you are not sure about your dates, call us. The consultation is free. 📞 (855) 435-3666
If you are past the deadline, call us anyway. We may still be able to help.
Court and Venue in Warren
Warren is in Macomb County. Macomb County's general civil trial court is the 16th Circuit Court, which covers Macomb County. Michigan also has a lower court for smaller civil claims, so the amount in dispute can change where a case is filed. Which court hears a particular case still depends on its facts, the warranty issues involved and the law it is brought under.
The Michigan lemon law is Mich. Comp. Laws §257.1401 to §257.1410. If the manufacturer's arbitration program is state-certified, the consumer must use it.
The repair test in the statute is 4 repair attempts for the same defect, or 30 cumulative calendar days with the vehicle out of service. The statutory remedy is a replacement vehicle or full refund (minus reasonable use offset). The court may award a consumer who prevails costs and reasonable attorney fees.

Michigan Lemon Law - New Motor Vehicle Warranties Act: The Rules That Decide a Warren Claim
Michigan law sets a repair test, an arbitration rule and a deadline, and Court and Venue above already explains those three. Here are a few of its other rules.
Notable provisions of Michigan Lemon Law - New Motor Vehicle Warranties Act
Michigan requires written notice to the manufacturer. The manufacturer gets a final repair attempt. Covers vehicles purchased for personal use. As the home of the Big Three automakers, Michigan has extensive case law on lemon claims.

What The Manufacturer Owes You
Under Michigan law the remedy is replacement vehicle or full refund (minus reasonable use offset). A qualifying MI case from Warren usually closes in one of these three ways.
Refund
The car goes back to the manufacturer, which returns what you paid, with the taxes, registration fees and finance charges, less a reasonable use offset.
Replacement Vehicle
The manufacturer swaps your car for a comparable new one and pays for the exchange.
Cash Settlement
You hold on to the car and are paid for the value the defect cost you. This one is not in the statute. It is negotiated.
