2022 Genesis G70 Lemon Law Case Study
Recurring Safety System Failures in a Genesis G70
Our client purchased a brand-new 2022 Genesis G70 from Genesis of the South Shore in West Islip, New York, on December 10, 2021. What should have been a premium luxury sedan experience quickly turned into a frustrating cycle of electrical failures, safety system malfunctions, and repeated trips to the dealer.
Starting in May 2023, the vehicle developed a pattern of recurring blind spot monitor failures, infotainment blackouts, and dangerous braking malfunctions — including the active brake system engaging on its own with no obstruction present. Despite five separate repair visits spanning nearly two years, the problems were never permanently resolved.
What Went Wrong
- Blind spot monitor malfunction — the passenger-side blind spot monitoring system repeatedly failed, creating a dangerous blind spot on highway merges and lane changes
- Infotainment and radio failures — the radio screen went black and cut off intermittently, and the middle console stopped working entirely
- Phantom braking — the active brake system engaged while reversing with no obstruction behind the vehicle, a serious safety hazard
- Vehicle hesitation — the car hesitated while driving, creating unpredictable acceleration behavior
- Check engine light — illuminated during the first repair visit alongside other electrical failures
A Textbook Lemon Law Case Under New York Law
This case presented one of the strongest lemon law claims we've seen — exceeding New York's statutory thresholds by a wide margin:
- Far exceeded the repair attempt threshold: New York's Lemon Law presumes a vehicle is a lemon after 4 repair attempts for the same defect. This Genesis G70 had 5 visits with the blind spot monitor issue recurring across multiple visits
- Over 4× the days-out-of-service threshold: New York requires 30 cumulative days out of service. This vehicle spent 127 days — more than four months — in the shop
- Safety-critical defects: The phantom braking and blind spot monitor failures weren't just inconveniences — they were active safety hazards that endangered the driver, passengers, and other motorists
- Pattern of failure: The recurring nature of the blind spot monitor issue across multiple visits (May 2023, February 2024, September 2024, December 2024) demonstrated that the manufacturer was unable to permanently repair the defect
A Pattern of Unresolved Defects
May 9 – May 31, 2023 (23 days)
Passenger-side blind spot monitor malfunction, check engine light on, and passenger rear tire leaking. Vehicle held for over three weeks.
February 27 – 29, 2024 (3 days)
Radio screen going black and cutting off. Blind spot assistance warning reappearing — the same issue from the first visit returned.
May 15 – July 31, 2024 (78 days)
Radio glitching, sidewall damage on tires, and middle console not working. The longest single repair stay — nearly three months with the vehicle unusable.
September 4 – 6, 2024 (3 days)
Blind spot assistance error light returned again. Vehicle hesitating while driving. Most critically: active brake engaging in reverse with no obstruction — a serious safety defect.
December 18 – 27, 2024 (10 days)
Open recall addressed. Infotainment screen went completely black again. The fifth visit in under two years — the problems were never truly fixed.
